Amends SDCL 23-5C-2 to require a law enforcement agency in possession of a sexual assault kit to preserve the kit for at least seven years from the date of the examination or treatment, or until the victim reaches the age of twenty-five, whichever is later, before destruction; requires the health care facility to inform the victim of that retention period and to transfer the kit in a manner protecting victim confidentiality and evidentiary integrity; provides for use of the anonymous code number to identify the appropriate kit when a victim later elects to report.
