NY: Forensic DNA methodology and familial searching (9 NYCRR 6192.3)

Forensic Genetic Genealogy Regulation

Commission on Forensic Science regulation setting forensic DNA methodology, with loci requirements tied to the NDIS Operating Procedures, and governing familial searching at subdivisions (h)-(k). A familial search may be run only where there is no match or partial match in the databank and the forensic profile is associated with a Penal Law Article 125 felony, or exigent circumstances exist. Requests must be made jointly by the investigating agency and prosecutor; DCJS confirms the case requirements and the State Police run approved searches. Results must be released with a statement that they are not a definitive statement of a biological relationship.
