Forensic Genetic Genealogy Legislation

Enacted Utah Code § 53-10-403.7 limiting law enforcement use of investigative genetic genealogy (IGG) to qualifying cases (violent felony investigations or identification of missing or unknown individuals) and only after a CODIS search produces no match and the agency, Bureau of Forensic Services, and prosecutor consult; third-party DNA samples require informed consent or prosecutor-authorized lawful covert collection, and agencies may use only genealogy services that notify users and offer opt-outs. Required confirmatory testing before an IGG-aided arrest, set retention/destruction rules and annual reporting, and amended § 78B-9-301 to allow court-ordered IGG in postconviction DNA proceedings.
