Amended § 760.40, F.S., providing definitions and prohibiting the collection, retention, submission for analysis, analysis, or disclosure of another person's DNA sample or DNA analysis results without that person's express consent, with graduated criminal penalties. Created exemptions for criminal investigations and prosecutions, court-ordered testing, newborn screening, emergency medical treatment, paternity determinations, and research conducted in compliance with 45 C.F.R. parts 46 and 160/164 and 21 C.F.R. parts 50 and 56. Applies only to DNA samples collected from a person in Florida after the act's effective date. Effective October 1, 2021.
