CA: An Act Requiring a Second Sexual Assault Kit Audit and SAFE-T Database Records (SB 464, Ch. 715, 2023)

Amended Penal Code §§ 680, 680.3, and 11116.10 and repealed and added § 680.4, requiring a second statewide audit of untested sexual assault evidence kits and requiring every law enforcement agency and crime laboratory to create a record in the SAFE-T database by July 1, 2026. Medical facilities and non-law-enforcement entities must report data to the Department of Justice by July 1, 2026, and DOJ must report to the Legislature by July 1, 2027. Victims may request that their kit not be tested; suspect kits are within the audit scope. Approved by the Governor and filed with the Secretary of State October 10, 2023.
