US: Preservation of Biological Evidence (28 C.F.R. Part 28, Subpart C)

Implements 18 U.S.C. 3600A. Requires the government to preserve biological evidence secured in a federal investigation or prosecution while the defendant is under a sentence of imprisonment. Covered evidence is sexual assault forensic examination kits and semen, blood, saliva, hair, skin tissue or other identified biological material. Sections 28.21-28.28 set the requirement, its exceptions, non-preemption and sanctions.
