Maryland State Police Crime Laboratory rule on collecting samples. A DNA sample must be collected from an individual charged with a crime of violence or burglary (or an attempt to commit either), convicted of a qualifying crime, or ordered by a court. Samples collected upon charge are taken during booking by the sheriff's office, police department, regional jail or other entity specified by the Secretary responsible for booking. An arrestee sample may not be tested or placed into the Statewide DNA Data Base System before the first scheduled arraignment date.
