Adds a new Chapter 163 to Title 8, Guam Code Annotated, establishing a bill of rights for victims of sexual assault. The forensic-evidence provisions give a victim the right not to be prevented from, or charged for, a medical forensic examination; the right to have forensic medical evidence, if collected, preserved without charge for the duration of the maximum applicable statute of limitations or twenty (20) years, whichever is shorter; the right on request to written information about the status of the evidence, including the location, testing date and testing results of a kit, whether a DNA profile was obtained from the kit, and whether the DNA profile was consistent with DNA profiles in state or federal databases; the right on written request to notice from the Guam Police Department not later than sixty (60) days before intended destruction or disposal of a kit; the right to be informed in writing of collection and preservation policies; and the right on written request to further preservation of the kit or its probative contents. This is Guam's rape-kit tracking and preservation statute and its only law addressing DNA-profile database comparison outside the sex-offender registry chapter.
