Enacted Utah Code § 53-10-404.5 and amended §§ 53-10-403 through -407 to require sheriffs, on and after January 1, 2011, to collect a DNA specimen at booking from any person booked for a violent felony (§ 76-3-203.5) whose DNA is not already on file; booking samples may not be processed until bindover, waiver of preliminary hearing, or indictment and must be destroyed if charges are not filed within 90 days. Raised the DNA fee from $100 to $150, created a destruction/expungement process on dismissal or acquittal, and made unauthorized disclosure or analysis of DNA information a third-degree felony. SB 277, 2010 General Session. Effective January 1, 2011.
