CA: DNA Fingerprint, Unsolved Crime and Innocence Protection Act (Proposition 69, 2004)

Approved by voters as Proposition 69, this initiative made two fundamental expansions of California's DNA databank: it extended convicted-offender collection from enumerated serious/violent felonies to all felony convictions and juvenile felony adjudications, and — under Penal Code § 296(a)(2)(C) — phased in DNA collection from all adults arrested for or charged with any felony, effective January 1, 2009, moving California to pre-conviction arrestee collection (a threshold about 30 states have adopted). Also changed the primary sample from blood to a buccal swab. Approved November 2, 2004.
