Ninety-day emergency act. Section 22 amends the DNA Sample Collection Act of 2001 by adding new sections 2a and 2b, the emergency counterpart of what became D.C. Official Code §§ 22-4152 and 22-4153. Section 2a authorizes the Mayor to collect a DNA sample from any individual charged by information, complaint or indictment with a crime of violence (§ 23-1331(4)), a dangerous crime (§ 23-1331(3)), the § 2(a)(3)-(7) sex offenses, or attempt or conspiracy to commit them; permits the court to direct collection at a charging appearance; allows collection to be limited to individuals who are fingerprinted; and routes samples to the FBI Laboratory or another FBI-approved laboratory. Section 2b parallels it for convicted offenders. Both sections permit the FBI-laboratory routing requirement to be waived, with FBI permission, where samples are analyzed by Rapid DNA instruments and results are included in CODIS, with terms defined by reference to 34 U.S.C. § 40703(c).
