TN: An Act Refining DNA Collection Procedures for Offenders (SB 1776, Acts 1995, ch. 382, 1995)

Rewrote T.C.A. § 40-35-321(b) to require a court, before sentencing a person convicted of (or a juvenile court adjudicating a delinquent child for) rape, aggravated rape, sexual battery, aggravated sexual battery (§§ 39-13-502 to 39-13-505), or incest (§ 39-15-302), to order a biological specimen for DNA analysis; set the collection procedure distinguishing non-incarcerated offenders (report to the health department, which forwards to the TBI) from incarcerated offenders, and barred probation or community corrections until the specimen is provided. Acts 1995, ch. 382 (SB 1776); effective upon becoming law.
