Established South Dakota's original State DNA Database and State DNA Databank, creating the state's DNA collection program from scratch under the State Forensic Laboratory and linked to CODIS; required a sample from any person convicted of or adjudicated delinquent for a 'qualifying offense' — any felony, a crime of violence under 22-1-2, or a sex offense under ch. 22-22 — on or after the effective date, collected on intake to confinement or as a condition of a non-incarceration sentence, with retroactive collection from those still in custody or under supervision; knowing refusal is a Class 5 felony.
