HI: An Act Establishing Hawaii’s DNA Database Program (HB 1733, Act 112, 2005)

Created Hawaii's original DNA database program by enacting Chapter 844D, establishing the state DNA database and data bank (linked to CODIS/NDIS) and mandating collection from all persons convicted of, pleading to, or found not guilty by reason of insanity of any felony — an all-felon standard at inception, phased in by felony class. Also established expungement on reversed convictions, extended the felony statute of limitations where DNA evidence is recovered, required retention of DNA-testable evidence, and created a post-conviction DNA-testing procedure. Act 112 (HB 1733); effective July 1, 2005.
