OH: An Act Establishing Arrest-Based DNA Collection and Evidence Preservation (SB 77, 2010)

Established arrest-based (pre-conviction) DNA collection in Ohio — a threshold only about 30 states have adopted — by amending R.C. 2901.07 to require, on and after July 1, 2011, a DNA specimen from any person 18 or older arrested for a felony offense, collected at the place the arrestee is taken after arrest. The act also created a biological-evidence preservation task force and mandated preservation and accessibility of biological evidence and the recording of certain custodial interrogations. SB 77; effective July 6, 2010 (arrest mandate operative July 1, 2011).
