Rapid DNA Legislation

Amended SDCL §§ 23-5A-17 and 23-5A-25 to permit DNA samples in the state database to be used — in addition to law enforcement identification and identification of human remains or missing persons — for a court-ordered determination of parentage, but only if no other sample is available and all other reasonable opportunities to locate a known sample have been exhausted.
