AR: An Act Clarifying DNA Sample Retention for Felony Arrestees (SB 526, Act 785 of 2023, 2023)

Amended A.C.A. § 12-12-1006(a) to clarify that when a receiving detention facility uses Rapid DNA technology to analyze a sample from a person arrested for any felony, that sample may not be retained or stored after the Rapid DNA identification process is completed; also made fingerprinting and photographing mandatory for felony arrests while making them permissive for Class A misdemeanor arrests. Act 785 of 2023.
