Added subdivision 4 to Minn. Stat. § 609.117, creating a court process to obtain DNA from offenders who were required to provide a specimen but never did and whose sentence or supervision has expired: on a prosecutor's motion supported by an affidavit and a BCA search showing no specimen on file, the court must issue an order to show cause returnable within 30 days; the offender may provide the specimen voluntarily, the court may order collection after a hearing, and if the offender fails to appear the court may order submission within 30 days and authorize a peace officer to detain and bring the offender before the court. 2010 Minn.
