CA: An Act Amending Penalties for Refusal to Provide DNA Specimens (AB 176, Ch. 88, 2009)

Amended Penal Code § 298.1 in the annual 'Maintenance of the codes' bill, retaining that a person who refuses, after written notice, to provide a required specimen, sample, or print impression is guilty of a misdemeanor punishable by a $500 fine and up to one year in county jail, and that peace officers may use reasonable force to collect from those who refuse. Ch. 88; effective January 1, 2010. (Technical code-maintenance amendment; no change to collection scope.)
